Terms and Conditions of Use of the “mexico.mx” Site
Objective of mexico.mx
The aim of the mexico.mx site is to provide information on Mexico in relation to quality of life, culture, tourism, economy, investment and good government.
These terms and conditions (hereinafter “terms and conditions”) govern the use of the internet site mexico.mx (hereinafter “the site”).
About the Responsible Organization and Its Basis
Within the framework of the National Digital Strategy, “the site” is administered by the Mexican Government, through the National Digital Strategy Coordination Office, of the President’s Office (hereinafter “the Coordination"), based on Articles 5, Sections IV and 10 of the Regulations of the President’s Office.
The User is obliged to make good use of “the site” in accordance with the purpose and objectives of the project, besides pledging in all cases to avoid damaging any content or component of it, information systems of government institutions, or contents of third parties that appear or are related to “the site”.
To not damage, disable or damage the computer systems of the President’s Office, any agency or entity of the Federal Public Administration, productive State enterprise, or third parties related to “the site”. Furthermore, he/she commits to:
1. Not modify in any way the computer applications of the Federal Government of Mexico related to “the site.”
2. Not use any computer program or modified versions of the systems in order to gain unauthorized access to any information system, content and/or services of “the site”.
3. To not disturb or interrupt access, functionality or use of “the site”, servers or networks connected to it, or fail to comply with any requirements, procedures or regulations of the network connection policy.
4. To refrain from using any services or content with illegal purposes prohibited in these “Terms and Conditions” and the applicable national and international laws;
5. To refrain from engaging in any conduct that may constitute a violation of the powers of the federal government or rights of third parties.
6. To respect the intellectual property that is part of or is displayed on “the Site”; to not violate copyright and industrial property rights referred to in the national laws, agreements and international instruments.
Limitation of Liability
“The Coordination” disclaims any liability that the User may acquire through any misuse or use contrary to the purposes of “the site”. By using “the site” or any of its components or contents, you exempt it from any responsibility for damages that use of it or its contents may cause you either directly, incidentally or consequentially.
Information Security Measures
In “the site”, we take care and make every effort to check and test all the stages of development and operation of “the site”. However, the User must take his/her own precautions to ensure that during access to it, he/she is not exposed to IT risks; computer viruses, malicious computer code or other forms of malicious software or inadequate practice, which may damage his/her own computer equipment, cellular phone or mobile device.
“The Coordination” is not responsible for any failure to comply with these “Terms and Conditions” where this failure is due to circumstances beyond our control, unforeseeable circumstances or force majeure.
The User agrees to respect the intellectual property rights of any work, creation or element published on or related to “the site” that may be subject to protection under copyright or industrial property laws.
Federal government intellectual property rights are those works and other elements belonging to the federal government that may be subject to protection under copyright or industrial property laws, pursuant to applicable Mexican legislation and international agreements and instruments.
Free Use. All images, sound, audio, video and other types of works published on “the site”, that belong to the federal government and that bear the words “Free Use” may be used in Mexico or abroad in compliance with Mexican law for any legal purpose whatsoever, provided the source and author are cited.
In the case of works and other elements protected by copyright or industrial property law that are part of or are published on “the site”, that do not bear the words “Free Use” and whose author and source are not specified, it shall be assumed that their use requires the express consent of the copyright holder. In the event “the site” is to be put to a use not stipulated in these “Terms and Conditions”, permission must be obtained directly from the copyright holders, without this affecting the rights of third parties.
Exclusive third-party rights. In the case of works protected by copyright, including but not restricted to images, sounds, text, publishing, video, photography, voice-overs, databases, etc., and any content that is subject to protection under industrial property law, including but not restricted to patents, profit models, industrial design, trade secrets, brands, slogans or logotypes that is published on “the site”, and whose author and/or source or some other characteristic is provided to suggest the copyright does not belong to the federal government but to a third party, it shall be understood that the express permission of the author or copyright holder is required before it may be used under Mexican or international law.
Express permission of the copyright holder (e.g. the letter “X”). As regards works protected by copyright, such as photographs, sounds, audios, videos, textual quotes, song lyrics, poems, stories, etc., and any creation or element protected by industrial property law, the express permission of the author or copyright holder, where applicable, must be requested directly prior to any use or exploitation of them.
It shall be understood that anyone who submits files with their works, designs of the letter “X” or any other sample of their work as part of this competition tacitly accepts these “Terms and Conditions” and hereby authorizes the publication of said works on “the site” and in any Mexican or foreign media, in addition to their use for any type of representation required for the purposes of “the site”, pursuant to the restrictions set forth in these “Terms and Conditions”.
The right to reproduce one’s own image. It shall be understood that anyone who sends in content for publication on “the site”, its social media or any other means of national or foreign communication or who sends in a photograph or work showing their body or face tacitly authorizes the use of their image so it can be associated with works of their authorship published or mentioned on “the site” and its use in any national or foreign communications media, pursuant to the purpose of “the site”, these “Terms and Conditions” and all applicable laws.
Privacy and Personal Data Protection Policy
The National Digital Strategy Coordination Office of the President’s Office is the administrative area responsible for the processing and use of the personal data obtained directly through “the site” or by electronic mail, in accordance with the Mexican Political Constitution and the Federal Law of Transparency and Access to Public Government Information, guidelines and provisions issued by the National Institute of Access to Information and Data Protection (www.inai.org.mx) and other applicable provisions in the matter.
“The site” only processes and protects personal data according to what is stated in the “Privacy and Policy” http://www.mexico.mx/privacidad
Applicable Law and Jurisdiction
